2 Background and Agreement

These Terms and Conditions govern student enrolment at The Global British School (Online School). By completing the enrolment form and ticking the acceptance box, the Parent or Guardian confirms acceptance of these terms and conditions.

3 Definitions

3.1 Agreement: The legally binding contract between The Global British School and the Customer regarding the enrolment, governed by these Terms and Conditions.

3.2 Business Day: Refers to any day that is not a Saturday, Sunday, or a public holiday in England.

3.3 Charges: The fees payable by the Customer for the Services.

3.4 Customer: The Parent or Guardian who is at least 18 years of age, responsible for completing the enrolment form and agreeing to these Terms and Conditions.

3.5 Deposit: Refundable 10% of total fee upon policy compliance.

3.6 Educational Services: Online education provided by The Global British School.
3.7 Enrolment: The process of registering a student (Pupil) for one or more courses offered under the Educational Services provided by The Global British School.

3.8 Enrolment Form: Registration form submitted by the Customer.
3.9 Pupil: Student registered for courses.
3.10 Registration Charge: Non-refundable administrative fee of £50.

4 Legal Obligations and Objectives

This section is established in compliance with the Electronic Commerce (EC Directive) Regulations 2002, the Electronic Commerce (Amendment etc) (EU Exit) Regulations 2019, the Data Protection Act 2018, and the UK GDPR. It serves to provide users with detailed identifying information about The Global British School and outlines the terms and conditions governing the use of our website. Additionally, it defines the requirements and conditions applicable to the enrolment process for courses offered by TGBS Online School, ensuring transparency and adherence to legal obligations. 

5 Fees and Payment Terms

5.1 Payment Options: An initial payment (first instalment and refundable deposit equal to 10% of the total fees) is required for instalment plans. No deposit is required for payments made in full upfront. The deposit will be refunded (for instalment plans) once all outstanding payments have been settled.


5.1 Fees must be paid as per the agreed terms, either in full or through instalments, as chosen by the customer on the enrolment form. 

5.2 Payment Methods: All payments must be completed through bank transfer or debit/credit card, with a 3% processing fee potentially applicable for card transactions.

5.3 Overdue Payments: Interest at 4% above the Bank of England’s base rate applies to late payments.

5.4 All payments must be made either via bank transfer or through debit/credit card, with a potential processing fee of 3% applicable for card transactions.

5.5 All charges are inclusive of VAT at the applicable prevailing rate.

5.6 The enrolment form can only be submitted after the successful payment of the Registration Fee.

6 Information Privacy

6.1 TGBS processes personal data in accordance with the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
6.2 TGBS will employ suitable technical and organizational measures to ensure a level of security proportional to the risk, safeguarding personal data against unauthorized access, accidental loss, destruction, or damage.

6.3 The personal data collected from the Customer and the Pupil will be used exclusively for delivering Educational Services, processing enrolments, and managing the relationship between the Customer, the Pupil, and TGBS.

6.4 TGBS may disclose personal data to third parties only when it is essential to achieve the purposes specified in these Terms and Conditions or when mandated by law. All third parties are required to maintain the confidentiality and security of the personal data and to use it solely for the intended purposes.

6.5 Personal data will be stored for the duration required to achieve the purposes for which it was collected, including meeting any legal, accounting, or reporting obligations.

6.7 The Customer has the right to request access to, correction, or deletion of personal data, as well as to request restrictions on processing, object to processing, and request data portability. All such requests must be submitted in writing to the Data Protection Unit at [email protected].

7 Cancellation of Classes

7.1 Classes missed by the student will also be recorded and accessible for later viewing.

7.2 In the event that TGBS cancels a lesson, a substitute lesson will be scheduled, or the session will be made available as a recorded video in the Lesson Library on the TGBS LMS.

7.3 Refunds will not be provided for any cancelled lesson

8 Cancellation and Withdrawal

8.1 Cancellation by TGBS: TGBS retains the right to immediately terminate this Agreement by issuing written notice to the Customer in cases of non-payment, significant violations of the Agreement, or any other specified reasons.

8.2 Cancellation by Customer: The designated Parent or Guardian is authorized to terminate this Agreement. The Customer may do so by providing TGBS with a written notice at least three (3) months before the desired termination date, either via email to TGBS’ official email address.

8.3 Refund Policy: Any deposit paid will be refunded once all outstanding payments have been settled and the termination process has been fully completed. Fees already paid will not be refunded in the event of termination by the Customer.

9 Provision of Services

9.1 TGBS will deliver the Services with due care and expertise, ensuring compliance with all relevant laws and regulations. TGBS does not guarantee specific academic outcomes.

9.2 TGBS will provide the Services throughout the academic term, covering periods when classes are in session, but excluding school holidays and breaks.

10 Obligations and Legal Accountability

10.1 TGBS is not responsible for any student’s academic failure, inability to gain admission to another institution, injuries, death, or any other damages resulting from or related to this Agreement or the use of the Services.

10.2 TGBS shall not be held responsible or liable for any failure or delay in fulfilling its obligations under this Agreement if such failure or delay results from circumstances beyond its reasonable control. These include, but are not limited to, natural disasters, war, riots, civil disturbances, malicious damage, compliance with legal or governmental directives, accidents, equipment or machinery breakdowns, fires, floods, storms, or failures by suppliers or subcontractors.

10.3 To the maximum extent allowed by law, TGBS shall not be responsible for any direct, indirect, incidental, special, or consequential damages resulting from or related to this Agreement or the use of the Services by the Parent or Student, even if such damages were foreseeable.

10.4 The Services are intended solely for personal and domestic use. The Parent/Guardian agrees not to utilize them for any commercial or business-related activities.

10.5 Despite the limitations stated above, this Agreement does not exclude or restrict TGBS’ liability for Fraud or intentional misrepresentation; and any other liability that cannot be lawfully excluded or limited under applicable regulations.

10.6 The Customer agrees to indemnify and protect TGBS from any liabilities, costs, expenses, damages, or losses that TGBS may suffer or incur as a result of the Customer’s or the Pupil’s use of the Services or any breach of this Agreement.

11 Agreement Duration and Course Schedule

11.1 This Agreement becomes effective when the Customer accepts these Terms and Conditions by selecting the checkbox in the enrolment form and shall remain valid for the specified period unless terminated earlier under the provisions outlined herein.

11.2 Upon submission of the enrolment form, TGBS will deliver the educational services as scheduled.

11.3 The Customer is solely responsible for arranging and covering the costs of the Pupil’s examination registration.

11.4 TGBS does not provide guarantees regarding specific exam outcomes or acceptance into other educational institutions.

12 Customer Representations and Obligations

The Customer affirms that:

12.1 They are at least 18 years old.

12.2 They have the legal authority to enter into this Agreement on behalf of themselves and the Pupil.

12.3 They will comply with all TGBS policies and regulations.

12.4 They have obtained any necessary consents to be bound by this Agreement.

13 Pupil Identification

The Customer agrees to provide valid identification for the Pupil during the enrolment process or upon request by TGBS.

14 Force Majeure

14.1 If these uncontrollable circumstances persist for more than thirty (30) days, either party may terminate the Agreement by providing written notice.

14.2 TGBS shall not be liable for any delays or failure to fulfil its obligations under this Agreement due to circumstances beyond its reasonable control. Such circumstances include but are not limited to natural disasters, war, civil unrest, malicious acts, legal or regulatory compliance requirements, accidents, equipment breakdowns, fires, floods, storms, or third-party service failures.

15 Severability

If any clause within this Agreement is deemed unlawful, invalid, or unenforceable by a court or other competent authority in England and Wales, the remaining provisions shall remain fully effective.

16 User Agreement and Website Access

By using the TGBS website, you agree to abide by these Terms and Conditions, the Privacy Policy, and the Cookie Policy. If you do not agree with any part of these terms, please refrain from using the website. Accessing the website does not establish a contractual or business relationship with TGBS.

17 Data Security and Protection

17.1 Users must ensure the accuracy of any personal data provided. All data processing will be carried out in line with the Privacy Policy and relevant legal regulations.

17.2 TGBS implements technical and organizational safeguards to protect personal data. However, due to the nature of the internet, absolute security cannot be guaranteed.

18 Intellectual Property Rights

TGBS Online School retains ownership of all intellectual and industrial property rights associated with the website and its content. Users are not granted any rights to the content and may not alter, copy, or distribute it without explicit authorisation.

21 Liability Disclaimer

22.1 TGBS collects data from pupils and parents via the website, during enrolment, and throughout the educational process. Information may also be obtained from third parties, including prior educational institutions, social services, local authorities, and the Department for Education (DfE).

24 Amendments to Terms

TGBS reserves the right to modify these Terms at any time without prior notice. Users are encouraged to review the Terms periodically. The latest revision was made on 01.07.2024.

25 Acceptable Use and Restrictions

Users must not engage in any unlawful activities or misuse the website in a manner that could harm third-party rights or disrupt website functionality. Violations may result in legal consequences.

26 Account Registration and Security

26.1 Users are responsible for maintaining the confidentiality of their account credentials and bear liability for all activities conducted under their account.

26.2 Some services on the website may require users to create an account. Users must provide accurate and up-to-date information during registration.

27 Modifications to Services

27.1 TGBS has the sole discretion to reject any requests for service modifications.

27.2 The Customer must submit all service modification requests to TGBS in writing by email to the official email address of TGBS.

27.3 The Customer may request up to two service modifications per academic year at no additional cost. Any further modification requests will be subject to an administrative fee of £50 per request.

27.4 Any additional courses or service changes that incur extra charges must be fully paid before the modifications take effect.

28 Notices

28.2 A three (3) month notice period is required for any withdrawal, as outlined in this Agreement.

28.1 All notices under this Agreement must be in English and delivered either via 1st class signed-for post or email to the designated addresses provided by TGBS or by the Customer.

29 Governing Law and Jurisdiction

This Agreement is governed by the laws of England and Wales, and any disputes arising from or related to it shall be subject to the exclusive jurisdiction of the courts of England and Wales.

30 Revisions and Amendments

TGBS reserves the right to update these Terms without prior notice. Users are encouraged to review regularly.
